Üstün, who lives in the rent, bought an apartment from the residential project in Ümraniye Şerifali district of Dekon Construction in March 2012. 270 thousand TL was paid for the flat. The size of the area was 99.57 square meters. According to the statement, the company's sales officers told Üstün that he wanted to buy a sample apartment with the same dimensions. The Superior was delivered on December 27, 2012.

 After a short while he moved, he measured it in his apartment. In the measurement he made, he found that his office was 87.77 square meters, not 99.57, as it was in the contract. First of all, the company spoke verbally to the authorities. He demanded the difference to be paid to him. The company officials said that this situation would not be possible, but if the money they had paid was transferred, it would be possible for them to get it. When the parties could not reach an agreement, Üstün sent an alert to the company via notary public, demanding the payment of 25 thousand TL for the missing area in the apartment. On the negative response from the company to the notice, Üstün, Av. Mohammad Ufuk Tekin in May 2013 in the consumer court opened a compensation case.
